Evidence includes: (a) the pages identifying witnesses are missing; (b) at the time, negotiations were known to be going in Donnelly’s favour; (c) Marsden was slated to go on television immediately afterwards; (d) this occurred at a time when Donnelly and his lawyer were under a gag rule that precluded their comments.
