One of the most serious challenges to the Nisga’a Treaty is that it may be a de facto constitutional amendment, through the back door of S.35. This is now before the BC courts and will no doubt be resolved by the Supreme Court of Canada in the end. Until then, every “Third Order” solution that is proposed will be under a legal cloud.
